1. Introduction & Acceptance

Welcome to Am I Nuts (the "App"), operated by AM I NUTS B.V. ("we", "us", or "our"), a company incorporated under the laws of the Netherlands, with its registered address at Prinseneiland 43, 1013 LL Amsterdam, the Netherlands.

These Terms & Conditions ("Terms") govern your access to and use of the App. By creating an account and checking the "I agree to the Terms and Conditions" checkbox during registration, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use the App.

These Terms constitute a contract for the supply of a digital service in exchange for personal data and are subject to the applicable provisions of the Digital Content Directive and applicable local laws.

2. Eligibility

You must be at least 18 years of age to create an account and use the App. By registering, you represent and warrant that you are 18 years of age or older. If we learn that a user is under 18, we will terminate the account and delete associated personal data promptly.

3. Account Registration & Responsibilities

3.1 Account Creation

You may register for an account using either:

• Email and password: You must provide your full name, a valid email address, and a password (minimum 6 characters).
• Google Sign-In: Your name and email address will be retrieved from your Google account.

3.2 One Account Per Person

You may maintain only one account. Creating multiple accounts to manipulate the gamification system, poll results, or Circle dynamics is a violation of these Terms.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.

3.4 Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately at contact@aminuts.app if you suspect any unauthorised use of your account.

3.5 Guest Experience

A limited guest experience (answering onboarding questions) is available without registration. However, all core features — including viewing results, joining Circles, earning points, and seeing your Nuts Score — require a registered account.

3a. Your Rights as a Consumer (Digital Content Directive)

Am I Nuts is a digital service supplied in exchange for the provision of personal data as counter-performance. Directive (EU) 2019/770 on contracts for the supply of digital content and digital services, as implemented under applicable local laws therefore applies to your use of the App.

We are required to supply the App in conformity with these Terms. This means the App must: (a) be fit for the purpose for which it is intended; (b) possess the qualities described in these Terms; (c) be supplied with updates necessary to maintain conformity; and (d) meet the reasonable expectations you may have based on the nature of the App.

If the App fails to meet these requirements, you have the right to request: (a) repair or replacement (where applicable); or (b) a proportionate reduction in the counter-performance (i.e., the personal data you provide). Where the lack of conformity is serious and cannot be remedied, you may be entitled to terminate the contract. You may also terminate your use of the App at any time by deleting your account in accordance with these Terms. Upon termination, we will process your personal data in accordance with our Privacy Policy.

4. Description of the Service

4.1 Daily Polls

The App presents a daily set of poll-style questions. You select your answer from pre-defined options. Answers are submitted to our servers and permanently recorded. Individual poll answers cannot be edited after submission.

The daily question set rotates at 00:02 UTC.

4.2 Nuts Score

Your Nuts Score is calculated as: 100 − (average percentage of the options you picked across a daily result set). A higher score means your opinions were more unconventional relative to the community. The Nuts Score is derived from aggregate statistics and reflects yesterday's results.

4.3 Results

Poll results are displayed as aggregate percentage breakdowns. You cannot see which specific users selected which options — only the overall distribution is visible.

5. Circles (Social Groups)

5.1 Creating & Joining Circles

You may create named Circles or join existing Circles via invitation links. Circle membership is voluntary, and you may leave any Circle at any time.

5.2 Information Visible to Circle Members

By joining a Circle, you understand and agree that other members of the same Circle can see:

• Your first name, last name, and profile photo;
• Whether you have completed today's poll;
• Your streak (consecutive active days);
• Your total points;
• Circle-scoped aggregate poll results (percentage breakdowns within the Circle); and
• An activity feed showing your actions within the Circle (e.g., "completed today's poll", "joined the Circle").

The sharing of your name, photo, and activity data with Circle members constitutes disclosure of personal data to third parties. By joining a Circle, you acknowledge that you have informed yourself and agree with our Privacy Notice. Please refer to our Privacy Notice for full details of how your data is used within Circles.

5.3 Activity Visibility

Activity within a Circle is temporally gated: you can only see activities that occurred on or after the date you joined that Circle. You cannot view historical activity that predates your membership.

5.4 Circle Administration

Circle creators may rename or delete their Circle. Deleting a Circle removes it for all members. We are not responsible for any loss of Circle data resulting from a creator's decision to delete a Circle.

6. Referrals & Sharing

6.1 Referral Links

Each user is assigned a unique affiliation code. You may invite others to the App by sharing your personal referral link. When an invitee signs up and confirms their email, you may earn points as described in Section 7.

6.2 Sharing Questions

You may share specific question sets externally via a generated share link. Non-registered recipients can view the shared question set without creating an account.

6.3 Invitation Ethics

You must not use referral or sharing features for spamming, harassment, or any form of unsolicited bulk messaging. Abuse of the referral system may result in account suspension or termination.

7. Gamification (Points, Levels & Streaks)

The App includes a gamification system in which you earn points ("coins") for certain actions, including:

• Completing daily polls;
• Completing your profile;
• Successfully referring new users; and
• Sharing question sets (capped at 5 share-to-join rewards per user).

Points determine your in-app level. Streaks track consecutive days of poll completion.

8. User-Submitted Content

8.1 Content You May Submit

You may submit:

• Circle names: short text names for Circles you create.
• Custom poll questions: questions submitted for potential inclusion in the daily question set, subject to AI-based moderation and review.
• Profile photos: images uploaded from your device.

8.2 Licence Grant

By submitting any content to the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and create derivative works from your content, in connection with operating, developing, and improving the App. The license survives the termination of your account for content that has been incorporated into the services (such as published poll questions or answers thereto).

8.3 Content Standards

You represent that any content you submit:

• Does not infringe on the intellectual property or privacy rights of any third party;
• Is not unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable;
• Does not contain malware, spam, or deceptive content; and
• Complies with all applicable laws and regulations.

8.4 Content Moderation

User-submitted questions are subject to AI-based content review before publication. We reserve the right to reject, remove, or modify any user-submitted content at our sole discretion. Where we reject or remove content you have submitted, we will endeavor to inform you of the decision and the general reason for it, unless doing so would compromise security or our anti-abuse measures.

9. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable law;
• Create multiple accounts or impersonate another person;
• Attempt to manipulate poll results, the gamification system, or the Nuts Score;
• Exploit the referral system through fraudulent invitations or self-referrals;
• Use automated scripts, bots, scrapers, or other automated means to interact with the App;
• Attempt to gain unauthorised access to our servers, databases, or other users' accounts;
• Interfere with, disrupt, or impose an unreasonable burden on the App's infrastructure;
• Reverse-engineer, decompile, or disassemble any part of the App; or
• Use information obtained from the App to harass, abuse, or harm other users.
• Reporting illegal content: If you become aware of any content on the App that you believe to be illegal under applicable law (including unlawful hate speech, incitement to violence, or content that infringes third-party rights), you may report it to us by contacting contact@aminuts.app with a description of the content and the reason you believe it is illegal. We will assess all reports in good faith and take appropriate action.

10. Intellectual Property

10.1 Our Content

All poll questions, option text, app design, graphics, user interface, code, logos, trademarks, and other materials provided through the App (collectively, "Our Content") are owned by or licensed to AM I NUTS B.V. and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on Our Content without our prior written consent.

10.2 AI-Generated Content

Certain content within the App, including poll option illustrations and textual assessments of poll results, is generated using artificial intelligence. Such content is owned by AM I NUTS B.V..

10.3 Open-Source Attribution

The App uses the Inter and Caveat typefaces, both distributed under open-source licences (SIL Open Font Licence). The App also uses various open-source software libraries as listed in its dependency manifest.

11. AI-Generated Content

Parts of the App use artificial intelligence (OpenAI) to:

• Generate textual assessments and insights about poll results;
• Generate illustrative images for poll options; and
• Review user-submitted content for compliance with our content standards.

AI-generated content is based on anonymised, aggregate data. No personally identifiable information is shared with our AI provider.

AI-generated insights are provided for entertainment purposes and do not constitute professional, medical, psychological, or expert advice of any kind.

Where the App presents you with content that has been generated or significantly altered by artificial intelligence — including textual poll assessments and poll option illustrations — this content will be labelled as AI-generated within the App interface.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. By using the App, you acknowledge that you have read and understood our Privacy Policy.

13. Disclaimer of Professional Advice

The App is a social entertainment platform. Poll questions, results, Nuts Scores, AI-generated assessments, and all other content within the App are provided purely for entertainment and social engagement purposes.

Nothing in the App constitutes professional, medical, psychological, financial, legal, or any other form of expert advice. You should not make important life decisions based on your Nuts Score, poll results, or any content within the App. If you need professional advice, please consult a qualified professional.

14. No Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade, to the maximum extent permitted under applicable laws.

We do not warrant that:

• The App will be available at all times, uninterrupted, or error-free;
• Defects will be corrected in a timely manner;
• The App or its servers are free from viruses or other harmful components;
• The results obtained from using the App will be accurate, reliable, or meaningful; or
• The daily question set will be refreshed at exactly the scheduled time.

15. Limitation of Liability

To the maximum extent permitted by applicable Dutch and EU law:

• AM I NUTS B.V., its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of goodwill, or loss of profits, arising out of or in connection with your use of or inability to use the App.
• Our total aggregate liability for any claims arising out of or relating to these Terms or the App shall not exceed EUR 100 (one hundred euros) or the total amount you have paid us in the 12 months preceding the claim, whichever is greater.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law. In addition, nothing in these Terms limits or excludes any rights you may have under applicable data protection laws, or the implementation of the EU Content Directive under your applicable, local law (if applicable).

16. Account Suspension & Termination

We reserve the right to suspend or terminate your account at any time and without notice, if:

• You violate these Terms or our Privacy Policy;
• We reasonably believe your account is being used fraudulently or in an abusive manner;
• You create multiple accounts;
• We are required to do so by law or court order; or
• We decide to discontinue the App or any part of it.

Where legally permitted and reasonably practicable, we will aim to provide you with reasonable advance written notice before terminating or suspending your account.

Upon termination, your right to use the App ceases immediately. We will comply with our data retention and deletion obligations as set out in our Privacy Policy.

17. Account Deletion

You may delete your account at any time through the in-app account deletion feature accessible from your profile settings. Upon deletion:

• Your account will be deactivated and your data will be marked for deletion;
• Your data will be permanently and irreversibly anonymized after the retention period specified in our Privacy Policy;
• All active sessions will be terminated;
• Your membership in all Circles will be revoked; and
• Submitted poll answers and referral records may be retained in an anonymised or aggregated form.

Account deletion is irreversible. We cannot restore a deleted account or its associated data after permanent purging.

18. Modifications to the Service

We reserve the right to modify, update, suspend, or discontinue any aspect of the App at any time, with or without notice. This includes changes to features, content, question availability, the gamification system, scoring mechanisms, and operational schedules. We shall not be liable for any modification, suspension, or discontinuance of the App. If any modifications materially and adversely affect your access to or use of the App, we will provide you with reasonable advance written notice.

19. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will notify you through the App or by email at least 30 days before the changes take effect. The updated 'Effective Date' will appear at the top of this page.

If you do not agree to the revised Terms, you have the right to terminate your use of the App and delete your account before the changes take effect, without any penalty. If you continue to use the App after the revised Terms take effect, that constitutes your acceptance of the non-material changes only. Acceptance of material changes that alter the core nature of the service requires your active agreement.

20. Governing Law & Dispute Resolution

20.1 Governing Law

These Terms and any disputes arising from or in connection with them shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law principles.

20.2 Jurisdiction

Any dispute arising out of or in connection with these Terms shall be submitted exclusively to the competent courts of Amsterdam, the Netherlands. This does not affect your rights as a consumer under mandatory provisions of the law of the EU Member State in which you reside.

20.3 EU Online Dispute Resolution

If you are a consumer residing in the EU, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the original intent.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AM I NUTS B.V. regarding your use of the App. They supersede all prior agreements, understandings, and communications, whether written or oral.
